We reserve this right to protect our Users and our interests. Users agree that CustomerExperienceJobs.com and DarinPhillips.com may make such discretionary decisions and actions without liability, refunds, or other recourse.
CustomerExperienceJobs.com and DarinPhillips.com are compensated by Hiring Managers and/or Companies for the posting of jobs or requests. These posts are provided by third parties over whom CustomerExperienceJobs.com and DarinPhillips.com has no control. If a post or request violates our Terms of Service, CustomerExperienceJobs.com and DarinPhillips.com will remove it as soon as possible after we are notified. We do not actively review every post or message. Users may exaggerate - or blatantly lie about - knowledge, skills, experience, aptitude, work style, employment history or pay, etc. Once selected, Job Candidates may also lie about availability (e.g. family emergencies), request advance payment (e.g. computer broke), or make other false or misleading claims or statements. You know and understand this and will not hold CustomerExperienceJobs.com and/or DarinPhillips.com responsible or liable for false or misleading statements made by any User(s). Nor will you hold CustomerExperienceJobs.com and/or DarinPhillips.com for decisions or actions you take as a result of lies told by any User.The Hiring Manager and/or Company is responsible and liable for compliance with all applicable laws and regulations in their location. Job Candidates are responsible for and liable for compliance with all applicable laws and regulations in their location. CustomerExperienceJobs.com and DarinPhillips.com are not liable for legal, regulatory, ethical, or other violations by the Hiring Manager and/or Company and/or the Job Candidate. CustomerExperienceJobs.com and DarinPhillips.com does not confirm or validate the accuracy or completeness of any posts on our site - including those in the blogs. If any information is reported to us as inaccurate or incomplete, we will review and act on those posts as soon as possible. CustomerExperienceJobs.com and DarinPhillips.com does not control the selection process by Hiring Managers and/or Companies. You acknowledge and understand that the process that you impose upon Job Candidates are outside of our control and that you are completely liable for any legal violations or other transgressions in the materials and/or steps taken to source, attract, and select an Employee. There are no guarantees that you will find a match. If you publish a position or information on CustomerExperienceJobs.com and/or DarinPhillips.com, you understand that other Users can search the site and find your post(s). If another User or software grabs content from our site and publishes it somewhere else, CustomerExperienceJobs.com and DarinPhillips.com will not be responsible or liable for what those persons or companies do with that information. There are bad actors in the world and you acknowledge that CustomerExperienceJobs.com and DarinPhillips.com cannot be held responsible or liable for those third parties. All payments are handled directly by Stripe - outside of our sites or control. Thus, CustomerExperienceJobs.com and/or DarinPhillips.com are not responsible or liable for hacking of your payment information or Stripe account. Do not intentionally post false or misleading information. This includes impersonating another person or organization. Do not post fraudulent, unlawful, discriminatory, threatening, abusive, obscene, or biased information. Do not request or post anything that would violate local laws or regulations. Do not discriminate against any User for any reasons that are not directly related to the ability to perform. Do not solicit participation in pyramid schemes, investment opportunities, or other opportunities that are not directly related to selecting or being selected as a Job Candidate. Do not attempt to communicate with any User that asked not to be contacted. All positions must exchange work for payment. No unpaid positions (e.g. unpaid internships) are permitted. No Job Candidate may offer their services for free. Do not request or post biometric or official identification on CustomerExperienceJobs.com and/or DarinPhillips.com. This includes national identification numbers, photos of official documents, or other identifiers. Employment verification should only take place after a firm offer has been made - and that should be done off of our site(s) and platform(s). Do not require candidates to pay for any screening services. Candidates may not offer to pay for any screening services. Hiring Managers and/or Companies must pay for all steps in the sourcing, attracting, screening, and selecting processes - including any new hire training, background checks, assessments, drug tests, etc. Do not create a new account if you have been banned under any other alias. Do not post any protected information (e.g. copyrighted, trademarked, or confidential content) unless you have explicit, written permission from the content owner. You agree to defend, indemnify and hold harmless CustomerExperienceJobs.com and DarinPhillips.com and its Users from any claims resulting from all posted content. You agree to pay for all legal expenses, damages, royalties, and other fees and penalties associated with any and all information and collateral you post on CustomerExperienceJobs.com and/or DarinPhillips.com. Do not copy or redistribute any content or functionality found on CustomerExperienceJobs.com and/or DarinPhillips.com. Do not sell or disclose any information found or sourced through CustomerExperienceJobs.com and/or DarinPhillips.com. Other actions that are deemed to be detrimental to the Job Candidates, Hiring Managers and/or Companies, other Users, and our own company and reputation are also prohibited.
Violations will result in immediate removal and a permanent ban from CustomerExperienceJobs.com and DarinPhillips.com. Do not expect restrictions or warnings. We take the treatment of everyone we work with and for to be critical.
If you identify and share any ideas, feedback, opinions, or points of view about how the sites/platforms operate or about the information found on CustomerExperienceJobs.com and DarinPhillips.com, you agree that CustomerExperienceJobs.com and DarinPhillips.com can use that information without any additional compensation to you. Any disputes arising out of or in connection with these Terms of Service are governed by the state of Florida and any actions must be filed only in courts in Orange County, Florida. All Users of CustomerExperienceJobs.com and DarinPhillips.com from outside of the United States may enjoy the protections provided by laws in the country in which they have a habitual residence.
You shall indemnify, defend and hold harmless CustomerExperienceJobs.com and DarinPhillips.com, its agents, affiliates, and licensors from any claim or liability (including without limitation reasonable legal fees) arising out of or related to: (a) your violation of any term of this Terms of Service; (b) your use of, and access to CustomerExperienceJobs.com and DarinPhillips.com; (c) your loss of, or disclosure of, information gained from using CustomerExperienceJobs.com and DarinPhillips.com; (d) your violation of any applicable laws or regulations, including but not limited to the Fair Credit Reporting Act, any applicable employment, equality, or discrimination laws, and any applicable data protection or privacy laws (this includes any claims that Indeed as your agent violated any such laws); (e) your violation of any third party right, including without limitation any copyright, property, or privacy right; (f) any claim that your content caused damage to a third party; (g) your actions as a Hiring Manager and Company or Job Candidate, including without limitation doing or not doing or participating in the following: sourcing, attracting, screening, or selecting User(s); or (h) the activities of any third-party service providers you engage to assist you with activities related to your use of CustomerExperienceJobs.com and DarinPhillips.com. This defense and indemnification obligation will survive this Terms of Service and your use of CustomerExperienceJobs.com and DarinPhillips.com.
